Appellee, Leatha Dry Johnson, was charged by information with driving while intoxicated (DWI). The trial court granted Appellees motion to dismiss the information, and the State appealed. The Seventh Court of Appeals subsequently reversed the dismissal order and remanded the cause. Johnson v. State, 795 S.W.2d 329 (Tex.App.--Amarillo 1990). We granted Appellees petition for discretionary review, pursuant to Tex. R. App. Proc. 200(c)(2), to determine whether the trial court had the power to dismiss the cause without the States consent. We will reverse.
